In England, as of the 1st October 2008 permission is now required for all installations of impermeable paving in front gardens that exceeds 5 sqm and that which allows the run off of rain water to flow onto public highways. Please note that these regulations affect new driveways, extensions of driveways or relaying of replacing a drive.

Surface water run off is said to be one of the main causes of recent flooding disasters.The new regulations apply to all methods of laying a new drive: concrete, tarmac, natural paving slabs, block paving, gravel drives and resin bonded driveways. Permeable paving is not always suitable for the site and therefore a channeled drainage system that returns the rain water to the ground can be installed without the need for planning permission.
SUDS stands for Sustainable Urban Drainage Systems. The ideas behind it is that the paving needs to have some kind of drainage system that will control the rain water at source rather than draining into public drains. This could mean creating a drainage channel with a soak-away or a permeable surface that allows rain water to drain between gaps.
